Trans Woman Who Sued Salon Workers For Refusing To Wax Her Testicles Loses Court Cases

Well there’s a sentence I didn’t think I’d be writing today.

A few months ago, Jessiva Yaniv, a Canadian trans woman, filed human rights complaints against several waxing and aesthetic salon workers after accusing them of transphobic discrimination for refusing to wax her balls/ging gang goolies.

The tribunal heard that staff refused to perform the pubic hair removal procedure after she revealed she had a full set of male genitalia. It turned out Yaniv filed complaints against multiple beauty salons – claiming the aestheticians’ refusal to wax her scrotum was discriminatory.

Well good news for reason, as it’s been revealed that she has lost every one of her cases after the tribunal rejected her claims.

The decision noted:

Human rights legislation does not require a service provider to wax a type of genitals they are not trained for and have not consented to wax.

It also found that Yaniv “engaged in improper conduct,” “filed complaints for improper purposes,” and concluded Yaniv’s testimony was “disingenuous and self-serving.” Finally, Yaniv was “evasive and argumentative and contradicted herself” while giving evidence.

Now she has been forced to pay the workers over the case- which saw one forced out of business as a result of Yaniv’s claim.

A number of the salon workers voiced religious objections to carrying out the procedures.

Others said they weren’t appropriately trained in waxing a scrotum.

Because some of the salons in question had never offered services to wax anyone’s scrotum, the tribunal said, it could not be said to be discriminating against Ms Yaniv.

The verdict from the tribunal read: “Human rights legislation does not require a service provider to wax a type of genitals they are not trained for and have not consented to wax.”

Yaniv, the ruling said, “targeted small businesses, manufactured the conditions for a human rights complaint, and then leveraged that complaint to pursue a financial settlement from parties who were unsophisticated and unlikely to mount a proper defence”.
